Terms of Service
These terms apply to WPComfy care plans and related services. Please read them before you subscribe. By placing an order you confirm that you have read and agree to them.
1. Who we are
WPComfy is a WordPress care service provided by Esumo sp. z o.o. (“we”, “us”), registered at Gałczyńskiego 14, 05-091 Ząbki, VAT ID PL1251686662, REGON: 382210840. You can reach us at jay@wpcomfy.com.
2. Definitions
- Client — the business or person who orders a plan (“you”).
- Website — the WordPress website named in your order.
- Plan — the care plan you choose (Essential, Care, Studio or Commerce), as described on our website at the time of purchase.
- Included hours — the monthly allowance of support and development time that comes with Care, Studio and Commerce.
- Managed hosting — the optional hosting add-on described in section 8.
3. Who the service is for
Our plans are designed for businesses, organisations and agencies. If you order as a consumer, or as a sole trader who enjoys consumer protection under applicable law, your statutory rights — including the right of withdrawal described in our Refund & Cancellation Policy — are not affected by these terms.
4. What each plan includes
Each plan covers one website and includes the maintenance routine and allowances shown on our website when you subscribe: scheduled updates, daily off-site backups, uptime and SSL monitoring, a weekly check of one nominated form where it can be tested safely, and a monthly care summary. Care, Studio and Commerce add included hours; Studio and Commerce add a monthly analytics review; WooCommerce care is available in Commerce only.
Included hours are a monthly allowance. Unused hours do not carry over to the next month and are not refunded. We estimate requests before starting work; if a request needs more time than your remaining allowance, we agree with you whether to reduce the scope, schedule it later or quote it separately.
Unless agreed in writing, plans do not include: fixing problems that existed before care began, malware cleanup, clearing a large backlog of outdated software, redesigns and new features beyond included hours, content creation, or the operation of third-party services such as your host, email provider, payment gateway or other integrations. If an update we carried out causes a problem, fixing or rolling it back is part of maintenance and does not use your included hours.
5. Ordering and your account
You subscribe through our checkout. An account is created for you so you can manage your subscription, invoices and site setup, and we send a link to set your password. A plan starts on the date of payment.
After purchase we review the website and agree access. If we find that we cannot look after the website within the plan you bought — for example because of an existing infection or an unsupported setup — we will explain why and either suggest a suitable option or cancel the plan and refund the first payment in full.
6. Access and your website
You will give us access to the website and, where needed, to its hosting, using named accounts rather than shared passwords. Please never send passwords by email. You confirm that you are entitled to give us this access and to have the work carried out.
You remain responsible for the website’s content, for keeping your domain and any premium plugin or theme licences active, and for telling us about changes that may affect our work, such as moving host or installing new plugins.
7. Prices, billing and taxes
Prices are shown in euro per website per month. Subscriptions are billed monthly in advance and renew automatically until cancelled. Payments are processed securely by Stripe; we do not store your card details.
VAT or other taxes are added where they apply. Business customers in the EU outside Poland with a valid VAT ID may be invoiced under the reverse-charge mechanism. We issue an invoice for each payment.
If a payment fails, we will retry it and let you know. If it remains unpaid, we may pause the service until the account is brought up to date. We may change our prices with at least 30 days’ notice; a new price applies from your next billing date after the notice period, and you may cancel before it takes effect.
8. Managed hosting
If you add managed hosting, its monthly price — €15 for Essential, Care and Studio, and €25 for Commerce — is part of your subscription and renews with it. We choose and manage the hosting environment and plan the move of your website with you after purchase. Hosting is provided for the website covered by your plan and is subject to reasonable use; if the website needs significantly more resources, we will discuss options with you before making any change.
When a subscription with managed hosting ends, the hosting stays active until the end of the paid period, and we will help you move the website and its data to a host of your choice.
9. How we work and respond
Automated monitoring runs continuously. Our team works Monday to Friday, excluding Polish public holidays, and responds to requests and alerts during those working hours. The service is not a round-the-clock emergency service unless agreed otherwise in writing. We communicate in English.
10. Cancellation and termination
You can cancel at any time from your account or by email. Cancellation takes effect at the end of the current billing period; the service continues until then. Payments for a period already started are not refunded, except as described in section 5 and in our Refund & Cancellation Policy, or where the law requires otherwise.
We may end a subscription with 30 days’ notice, or immediately if payments remain unpaid, if access needed for the work is withdrawn, or in case of serious breach of these terms. On termination we remove our access to your systems at your request.
11. Liability
We carry out our work with reasonable skill and care. We are not responsible for failures of third-party software or services outside our control, such as your host, plugins and themes by other developers, payment providers or email delivery, nor for losses caused by changes made to the website by others.
For business customers, our total liability arising from the service is limited to the fees you paid in the three months before the event giving rise to the claim, and we are not liable for indirect losses such as lost profits or lost data beyond our obligation to restore from available backups. Nothing in these terms limits liability that cannot be limited by law.
12. Intellectual property
You keep all rights to your website and its content. Code and materials we create for you within your plan become yours once paid for. Our internal tools, templates and documentation remain ours.
13. Personal data
How we handle personal data about you is described in our Privacy Policy. Where our work on your website involves personal data of your customers or users, we act as your processor and will sign a data processing agreement on request.
14. Changes to these terms
We may update these terms. For existing subscriptions, material changes take effect 30 days after we notify you by email; if you do not agree, you may cancel before they apply.
15. Governing law
These terms are governed by Polish law. Disputes with business customers are resolved by the court competent for our registered office. Consumers keep the protection of the mandatory laws of their country of residence and may use their local courts.
